On successful completion of this subject, students will be able to:
1.
Develop theoretical and critical knowledge regarding the nature, origins and history of equity;
2.
Explain and critically analyse the legal doctrines applicable to equitable interests in real and personal property;
3.
Demonstrate knowledge of equitable doctrine in relation to fiduciary relationships and confidentiality;
4.
Apply these doctrinal elements to solve problems concerning conflicting property claims and the acquisition of property rights (including rights under express, resulting and constructive trusts);
5.
Evaluate the legal doctrine applicable to the law of trusts in Australia and identify potential areas for legal reform; and
6.
Identify and evaluate the responsibilities of the lawyer involved with matters concerning the law of trusts.
