Learning outcomes

On successful completion of this subject, students will be able to:
1.
Develop and communicate theoretical and critical knowledge regarding the fundamental themes, historical evolution and jurisprudential frameworks of legal theory;
2.
Critically analyse the application of these fundamental themes and schools of legal theory in the context of legal interpretation's practices and processes;
3.
Critically analyse and evaluate the ways in which law draws upon the range of legal theories and philosophies in the development of doctrine, law reform and legal policy formation within the wider social and political contexts of law and its practices;
4.
Critically engage with the tensions that exist between conventional legal theories and critical legal theories; and
5.
Undertake high level analysis using legal theory to identify gaps in the law, its doctrines, principles and practices.
