Learning outcomes
On successful completion of this subject, students will be able to:
1.
Explain the origin of each of the major remedies at common law and in equity, and the principles governing the availability of those remedies;
2.
Analyse different factual situations to identify the remedies which may be available to an injured or wronged party and construct sound arguments to support or oppose the grant of those remedies;
3.
Explain the steps in the civil litigation process in New South Wales that may be used to support or oppose the pursuit of the major remedies;
4.
Analyse different factual situations to identify the most appropriate procedural steps to utilise and construct sound arguments to support or oppose the use of these steps; and
5.
Evaluate the need for reform in the areas of remedies and civil procedure and critique the shape that any desirable reforms should take.
