This subject examines the notion of the state and state power; limitations on state power; the notion of division and separation of powers; mechanisms of accountability and control of government officials, including access to government information, integrity bodies, merits review tribunals and judicial review.

Learning outcomes

On successful completion of this subject, students will be able to:
1.
Recognise and evaluate the key principles of public law, including accountability, responsible government and the rule of law.
2.
Critically analyse the framework and rationale for merits and judicial review in Australia, including the role of procedural fairness in government action.
3.
Evaluate and analyse the principles of open government, including reasons for decisions and the procedures for obtaining access to public and private information held by the government.
4.
Critically analyse the nature and constitutional framework for state power.
5.
Critically analyse and evaluate the network of integrity and accountability bodies in Australia, including but not limited to Ombudsmen, Royal Commissions and Anti-corruption bodies.
